A charitable donation account (CDA) is a hybrid charitable and investment vehicle, satisfying the conditions of NCUA guidance, that you may fund as a means to provide donations to qualified charities. If you fund a CDA that satisfies certain conditions, then you may do so free from the investment limitations of the Federal Credit Union Act. Charitable donation accounts offer the opportunity for enhanced earnings through non-traditional investment alternatives. The new investments could include corporate bonds, preferred stocks or other asset classes. Alternative investment accounts often offer higher returns than traditional investments. They also provide a way to diversify portfolios. The additional income is used to supplement or grow charitable donations. When did the NCUA approve the charitable donation account rule? The CDA rule was developed as part of NCUA’s Regulatory Modernization Initiative. This rule was approved in 2013 and allows federalto invest in accounts to fund charitable causes, and it sets safeguards to ensure that these accounts are used for their intended purposes. Are there any limits on the size of my CDA? To protect safety and soundness, the final rule caps aggregate funding of a CDA at 5% of a federal credit union’s net worth. Are there any restrictions? The rule requires federalto ensure that: 1) A minimum of 51 percent of the total return from such an account must be distributed to one or more 501(c)(3) charities. 2) Distributions must be made to qualified charities no less frequently than every five years. 3) Assets in a charitable donation account must be held in segregated custodial accounts or special purpose entities regulated by the Office of the Comptroller of the Currency, the U.S. Securities and Exchange Commission or other federal or state financial regulatory agency.
